This “limited power of attorney” is given to BCS in compliance with section 611 of the Federal Fair Credit Reporting Act. Retainer Agreement: This agreement describes the specific term between BCS and Client. BCS is to provide Credit Education. BCS will educate Client on credit and teach Client how to build and establish credit (if applicable). BCS will prepare correspondence to credit bureaus while working to remove negative items that are misleading, obsolete and/or inaccurate. By submitting this form, Client agrees and adheres to all terms contained within this agreement and authorizes BCS or its affiliate to pull Client’s credit report if it is unable to be provided. Client understands that this is not a debt consolidation or bill payment program. BCS will use federal law in its attempt to correct errors and other misleading information found in Client’s credit report by challenging the credit items that Client identifies to BCS as inaccurate, misleading, or unverifiable. When BCS receives legible copies of Client’s credit reports, it will draft and send letters to the three major credit bureaus on Client’s behalf and in Client’s names. This retainer agreement does in no way include litigation services. Due to unpredictability of the major credit bureaus, along with other factors, BCS cannot guarantee a specific outcome or accurately predict how long the process of correcting disputed items will take. After work has been performed, Client will continue month-to-month service until a notice of cancellation is submitted and received by BCS. BCS does not charge Client in advance for any services. BCS charges Client only after the initial setup, then monthly for work that has been performed. The improvement of Client’s credit situation is entirely up to Clients future actions and decisions to improve Client’s own credit situation. There are things that Client, as a consumer, will have to do on Clients own to maintain credit as well. If these things are not done, Client understands that it will directly affect their credit outcome. While retaining BCS, Client agrees: 1. To notify BCS of negative items within Client’s credit report that is believed to be accurate or should remain as reported on Client’s credit reports. 2. To pay BCS the amounts as listed on the Payment Agreement. (See below) 3. Promptly forward all correspondence to BCS that is received from the credit bureaus, furnishers, or others as the result of BCS’s efforts on Client’s behalf, and promptly inform BCS of any change of address. 4. That Client intentionally sought out BCS, which is based in the State of Utah, to perform the services identified here, and that the services may be performed by any attorney or legal assistant or employee working for or in association with BCS. 5. To follow the BCS program and do as BCS advises for best results. 6. That Client has received and read the consumer credit file rights under state and federal law as attached. -This agreement has been executed exclusively in the State of Utah. Utah law, without regard to conflict of law provisions, and federal law govern this agreement. Any legal or equitable action concerning this agreement shall be initiated only in Salt Lake County, Utah, and both parties agree to submit to the personal and exclusive jurisdiction of the courts therein. Any breach of this contract entitles the prevailing party to recover reasonable attorney fees and costs. BCS may terminate this agreement at any time and for any reason. I/We understand that with proper information I could undertake the same or similar techniques to repair my own credit and as choosing to hire this Services Provider to undertake the services outlined in this agreement without duress or provocation. Client agrees to hold BCS and its employees, officers, directors, agents and representatives harmless from any claim, suit action or demand made by any of Client’s creditors or any other person which may arise from the action(s) taken by Client’s creditors in connection with any services rendered by BCS on my behalf. In the event BCS engages in collection efforts, client will be required to reimburse BCS for out-of-pocket expenses as the result of such efforts Client may cancel this contract, without any penalty or obligation, within 5 business days from the date this contract is signed. After services have begun, Client may initiate cancellation of this contract with written notice to the address above at any time. Once notice is received, BCS agrees to cancel this customer agreement effective the end of the monthly cycle wherein the notice is received. Client will be charged final payment in the following month on the normal calendar date of service. See Notice of Cancellation. Payment Agreement- ALL payment will be processed by Credit/Debit Card -Client understands that the initial Setup fee, one-time option and/or credit education will be billed after initial work has been done. Monthly billing occurs in arrears. After each month’s services have been fully performed, client will be billed. -If Client chooses to suspend Client’s account for any reason, BCS will allow Client to do so for 1 period of 30 days at no charge with the understanding that BCS will not communicate with the credit bureaus on Client’s behalf during the suspended time frame. After 30 days Client may choose to remain in suspense mode for up to 6 months with a maintenance fee of $49 per month. After 6 months (or with Client’s written notice prior) Client’s account will be deactivated permanently and Client would be subject to the program set up fee to re-enroll. -If any form of payment Client supplies is uncollectible for any reason, BCS may charge Client a dishonored payment fee of $30.00. Client agrees not to close the bank account that BCS is authorized to withdraw payments from for the duration of time that BCS’s services are retained. Should Client be required to change the authorized bank account, Client must notify BCS immediately and complete a new Electric Payment Authorization, as any interruption in the payment of our fees will require BSC to discontinue your service agreement. The resulting actions undertaken by the credit card companies, collection agencies, and/or law firms against the client will not be the responsibility of BCS. Consumer Credit File Rights Under State and Federal Law You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any ”credit repair” company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported for 10 years. You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud. You have a right to sue a credit repair organization that violates the Credit Repair Organization Act. This law prohibits deceptive practices by credit repair organizations. You have the right to cancel your contract with any credit repair organization for any reason within 3 business days from the date you signed it. Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate. However, mistakes may occur. You may, on your own, notify a credit bureau in writing that you dispute the accuracy of information in your credit file. The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information. The credit bureau may not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau. If the credit bureau’s reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau, to be kept in your file, explaining why you think the record is inaccurate. The credit bureau must include a summary of your statement about disputed information with any report it issues about you.
